Our attorneys handle many matters for our clients. We have experience with business questions on payroll, employee termination, and vendor contracts, as well as leases and operating agreements.

Litigation
We have practiced in the area of Business Litigation for 25 years. Our legal opinions of a conflict always has a business side.
We have appeared in the United States District Courts in Georgia, Wisconsin, the Western District of Texas, and many of the different county courts in Georgia. Our attorneys have also represented clients before the 5th and 11th Federal Courts of Appeals, and the Court of Appeals, and the Supreme Court of Georgia.
We have represented financial institutions and non-traditional lenders in both State and Federal Court. Our experience includes prosecution of claims based upon Notes and Guarantees, as well as defending borrowers and guarantors. For our lender clients’ we have defended claims wrongful foreclosure claims and claims asserted under Dodd-Frank, RESPA, TILA and FCRA.
Our experience also includes breach of contract, fraud, reclamation, receiverships, and personal property foreclosures.
Bankruptcy
Our firm professionals have experience appearing before in many Bankruptcy Courts throughout Georgia and the southeast United States. We represent both debtors and creditors in business bankruptcy cases regularly.
We also represent creditors of all types in consumer bankruptcy cases, either appearing in the many jurisdictions in which the cases are filed or managing local counsel on behalf of the client. In support of the client’s need in these types of cases the Firm utilizes paralegals to maximize effeciencies and minimize costs to the client.
The Firm’s professionals also appear regularly on behalf of clients who have been sued in the bankruptcy courts. We have defended many clients in adversary proceedings brought by bankrutpcy trustees seeking to recover preferential transfers, and other avoidance action.
Bankruptcy and restructuring in particular is a combination of litigation and negotiation of a business problem under the administrative control of the Bankruptcy Court. The Bankruptcy Code provides a framework within which the debtor and its creditors must work to attain their goals. While the Bankruptcy Code provides the framework, the law that affects the parties is often the substantive commercial law of the state. Often intellectual property law, tax law and employment law come into play as well. Both Mr. McBryan and Ms. Aczel have significant experience representing creditors, trustee and creditors committees in bankruptcy cases in which all these issues and more arose. Additionally. Mr. McBryan has acted as debtor’s counsel in numerous cases.
